Terms of Service

1. Acceptance of These Terms

By creating an account, accessing, or using Wisaal (the "Service"), you ("user," "you") agree to be bound by these Terms of Service and our Privacy Policy. The Service is operated by Siaks Pty Ltd (trading as Inter-Sect Consults) ("we," "us," "our"). If you do not agree, do not use the Service.

2. Eligibility

To use Wisaal you must:

  • Be at least 18 years old;
  • Be single and not currently married to, or in any registered or religiously-recognised marriage or civil union with, another person;
  • Have the legal capacity to enter into a binding contract;
  • Not be barred from using introduction or matchmaking services under any law that applies to you; and
  • Not have been previously removed from Wisaal for breaching these Terms, unless we have reinstated you in writing.

You are solely responsible for ensuring your use of the Service complies with the laws of wherever you live.

3. What the Service Is

Wisaal is the Ta'aruf layer — a purposeful, boundaried introduction platform that helps Muslim users identify compatible partners for the purpose of marriage (Khitbah), built around selectable persona profiles rather than free-text bios. Wisaal responsibly narrows the field to people compatible in the ways that matter and serious enough to be worth a family conversation, then hands off to the actual Khitbah process rather than trying to digitize marriage end-to-end. The Service runs in three distinct stages:

  • Phase 1: Discovery — You build your persona using selectable categories (faith, lifestyle, values, partner preferences), and the system surfaces candidates who meet the compatibility threshold you set. This is the beginning of Ta'aruf: purposeful, boundaried acquaintance.
  • Phase 2: Conversation — Once both parties opt in to a match, a pseudonymous in-app conversation channel opens, allowing you to get to know each other while maintaining full anonymity. Progressive reveal mirrors the escalating formality of Ta'aruf moving toward Khitbah — gradation is the point, not a compromise.
  • Phase 3: Reveal (Toward Khitbah) — When both parties agree, you may initiate a "handshake" to formally exchange real identities and contact details. This hands off to the actual Khitbah process with your families — Wisaal's role ends at the handoff, not at the marriage itself.

Wisaal is not a casual dating, hookup, or general social-networking platform, nor does it digitize the marriage process end-to-end. Using it for any purpose other than seeking marriage is a breach of these Terms.

4. Account Registration and Verification

  • You must give accurate, current, and complete information during persona setup — including your marital status — and keep it updated.
  • You must complete the mandatory Liveness verification check before entering the matching pool. Submitting a static or pre-recorded image in place of a live check breaches these Terms.
  • You may not run more than one account, impersonate someone else, or create an account for someone else without their knowledge and consent.
  • A knowingly false marital-status declaration, or any other material misrepresentation we later discover, may result in immediate, permanent suspension without refund, in addition to any other remedy available to us or to affected users.

5. Your Responsibilities as a User

5.1 Be Honest and Accurate

  • Give truthful information in your persona profile — faith practice, marital status, marriage-intent timeline, children, and prior marriage history.
  • Update your profile promptly if your circumstances change and pause or close your account accordingly.
  • Never misrepresent your identity, age, religion, or intentions to another user at any stage.

5.2 Be Respectful

  • Treat every other user — and any wali or guardian they invite into a conversation — with respect.
  • Never engage in harassment, hate speech, threats, or communication a reasonable person would consider abusive or coercive.
  • Never request, send, or solicit sexually explicit, indecent, or otherwise inappropriate content at any stage.
  • Close a communication channel respectfully rather than through repeated unanswered messages or pressure.

5.3 Respect the Anonymity and Staged Process

  • Never try to identify, locate, or contact another user outside the Service before both sides have mutually completed a handshake reveal at Phase 3.
  • Never screenshot, record, forward, or otherwise share another user's conversation, profile, or content without that user's explicit consent.
  • Use information obtained through the Service only to evaluate a potential marriage match.

5.4 Keep It On-Purpose

  • Never use the Service to advertise, solicit money or gifts, recruit for a business, or promote a cause other than seeking a marriage partner.
  • Never scrape, harvest, or otherwise collect data about other users by automated or manual means.

5.5 Wali / Guardian Responsibilities

  • Only invite a wali, guardian, or family member into a conversation with that person's knowledge and agreement to keep what they see confidential.
  • You are responsible for the conduct of any wali or guardian you invite, as if it were your own, for the purposes of these Terms.

5.6 Report and Cooperate

  • Report suspected fake profiles, scams, underage users, or breaches of these Terms through the in-app report function.
  • Cooperate with reasonable requests from our Trust & Safety team while a report is being investigated.

5.7 Exercise Your Own Judgment

  • Use your own judgment — and involve your family or wali where relevant — before agreeing to a Phase 3 handshake or any in-person meeting.
  • Understand that Wisaal verifies identity only to the standard described in Section 8, does not run criminal background checks, and that any further due diligence is your own responsibility.

6. Conduct That's Never Allowed

In addition to Section 5, you must not:

  • Use the Service while currently married or in a registered civil union, except where your genuine circumstances and the persona fields allow and you disclose this accurately;
  • Use the Service for any unlawful purpose, including fraud, forced-marriage facilitation, or human trafficking;
  • Upload or send content that is unlawful, defamatory, obscene, or that infringes someone else's intellectual property or privacy;
  • Interfere with, disrupt, reverse-engineer, or gain unauthorised access to the Service or its systems;
  • Circumvent any verification, payment, rate-limiting, or anonymity mechanism built into the Service.

Breaching this section may lead to immediate suspension or termination and, where relevant, referral to law enforcement.

7. Subscriptions, Payments, and Refunds

  • Free core features: Persona building, compatibility matching, must-have filters, mutual messaging after a mutual match, and mandatory Liveness verification are free and will stay free. They are never moved behind a paid tier.
  • Reveal fee: A flat, one-time fee is charged to initiate or accept the identity reveal (handshake) at Phase 3. The fee is disclosed at the point of purchase before you commit.
  • Wisaal+ subscription: An optional premium subscription that unlocks enhanced features. Subscription terms — including price, billing frequency, and renewal — are shown at the point of purchase.
  • Payment processor: All payments are securely processed via Stripe. Your financial information is handled by Stripe per their PCI-compliant policies. Wisaal does not store full credit card details on our systems.
  • Subscriptions renew automatically unless cancelled before the renewal date in your account settings. Cancellation takes effect at the end of the current billing period.
  • Rescinding a reveal request: After a waiting period (currently 14 days) from your reveal proposal, you may rescind your request. You will receive a partial refund to your original payment method (currently 80% of the fee) or, at your option, a full credit to your in-app wallet balance for use toward future reveal fees.
  • Refunds are handled in line with the consumer protection law that applies to you, including the Australian Consumer Law's consumer guarantees, which apply regardless of anything else in these Terms and cannot be excluded.

8. Verification and Identity

  • Mandatory Liveness verification: A selfie liveness check is required before you are eligible to enter the matching pool.
  • Identity verification (government-issued ID): To proceed to the Phase 3 reveal (handshake), you must complete government-issued ID verification, processed securely via Stripe Identity. Identity verification documents are never stored on Wisaal servers — Stripe handles them per their policy.
  • A "verified" badge confirms only the matters described above. It is not a criminal background check, credit check, or character reference and should not be relied on as one.
  • Verification pricing (Early Bird vs. Late) is disclosed at the point of purchase. Early Bird pricing applies when you verify before reaching a handshake proposal; Late pricing applies from the handshake stage onward.

9. No Guarantee of Outcome

Wisaal facilitates introductions based on the preferences you provide. We do not guarantee that you will be matched, that a match will lead to a conversation, that a conversation will lead to Khitbah or marriage, or that any user you interact with is who they represent themselves to be beyond the verification described in Section 8. Any decision to proceed to Phase 3 disclosure, to meet another user, or to pursue marriage is made entirely at your own discretion and risk.

10. Limitation of Liability

To the maximum extent the law allows, and without limiting any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law:

  • Wisaal is provided "as is" and "as available," without warranties of any kind, express or implied;
  • We are not liable for the conduct of any user, including misrepresentation, harm, financial loss, or damage arising from your interaction with another user on or off the Service;
  • Our total liability for any claim arising from your use of the Service is capped at the amount you paid us, if any, in the 12 months before the claim.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

11. Data and Privacy

Our handling of your personal information — including what we collect, how we use it, retention periods, and your rights — is governed by our Privacy Policy, prepared with reference to the Privacy Act 1988 (Cth).

12. Moderation, Suspension, and Termination

  • We may review reported conduct, restrict a feature, or suspend or terminate an account for breaching these Terms.
  • Where we suspend or ban an account, we will provide the stated reason and a path to request human review — except where that would compromise an investigation, another user's safety, or a legal obligation.
  • You can delete your account at any time in your account settings. On deletion, your personal information is handled per our Privacy Policy and any applicable retention requirements.
  • We may suspend the Service, in whole or in part, for maintenance, legal, or safety reasons, with notice where reasonably practicable.

13. Indemnity

You agree to indemnify and hold Wisaal, its officers, employees, and affiliates harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your breach of any law, or your interaction with another user.

14. Changes to These Terms

We may update these Terms from time to time. Where a change is material, we will give reasonable notice (for example, in-app or by email) before it takes effect. Using the Service after a change takes effect means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any dispute arising from these Terms or your use of the Service will first go through our internal complaints process, and failing resolution, may be referred to the appropriate courts or dispute resolution mechanism in Australia.

16. Contact

Questions about these Terms can be submitted through the app's support function.
